United States Deportation of Aliens

Just as the federal government has the authority to allow people to immigrate to America from other countries, it has the power to send them away, or deport them. The deportation process involves legal proceedings in which aliens have certain rights, but they must know them and assert them. This is why it is usually of paramount importance for someone who is facing deportation to be represented by competent legal counsel.

As bad as deportation might be, things can get worse after a person has been deported. A deported alien may never be able to return to America, even to visit. Therefore, if an immigration judge orders that an alien be deported, an appeal to the Board of Immigration Appeals, filed by a competent law firm, is the only way the alien can try to protect his or her rights.

Who Can Be Deported?

Generally speaking, aliens who have been granted permanent residence, and aliens who are here as non-immigrants, can be deported. People who are in the United States illegally can also be deported.

These reasons include staying longer than a visa allows, committing and being convicted of certain kinds of crimes, coming to America using false documents, helping others enter the country illegally, gaining entry through a fraudulent marriage, violating the terms of their conditions of entry to the United States, and other grounds that have been established.

Does An Alien Have Any Rights in a Deportation Proceeding?

The answer is YES.

First of all, an alien has a right to be represented by an attorney. A competent immigration attorney will know the alien’s rights and will be able to assert them on his or her behalf. An alien can appear before an immigration judge without an attorney, but the alien will be expected to know and assert his or her rights, or these important rights will be deemed waived.

In the event an immigration judge orders that an alien be deported, there is a strict thirty day time period in which to file an appeal with the Board of Immigration Appeals. If the alien loses the appeal, there might still be hope through the federal court system. Again, having competent immigration counsel is usually extremely important.
